Terms and conditions
All sales made by Louise Cannon Cakes are subject to the following terms and conditions which are governed by the laws of England and Wales. Nothing contained within these terms and conditions affects your statutory rights as a consumer.
Please note that as cakes are custom-made to order, your 14-day cooling-off period under the Consumer Contracts Regulations 2013 does not apply once work has begun.
If there is anything you do not understand please feel free to contact me on louise@louisecannoncakes.co.uk.
I reserve the right to revise and amend these terms and conditions. However, you will only be subject to the terms and conditions in force at the time you place your order which will be sent to you with your first invoice. If you change your order date for any reason, you will be sent the most up to date terms and conditions with your new booking form and these will supersede any previously sent to you
By making your initial payment you are agreeing to the terms and conditions supplied so please read them carefully.
Wedding cakes T&Cs
1. Consultations
1.1. Consultations are by appointment only for wedding cakes. Appointments can be made by email, phone, or using the Get in Touch page on my website. Appointments last for approximately one hour and can be held virtually via Zoom, or in person at Louise Cannon Cakes, at your home, or at a mutually agreed location such as your venue.
1.2. If you wish to have a consultation before making your initial payment to secure your date this will be subject to a £35 charge which covers my time and costs. If you then choose to book the £35 will be deducted from initial payment on orders over £400 (excluding set-up and delivery charges)
1.3. The consultation process includes a tasting of up to three flavours of your choice.
1.4. If you choose a virtual consultation and would still like to have samples these can be posted to you.
1.5. You can call or email me if you need to discuss any aspects of your cake before making a booking. Bookings can also be made over the phone or by email without prior consultation.
1.6. During your consultation I will sketch out the design of your cake. I will send a copy of the design to you after your consultation but the design will always remain copyright of Louise Cannon Cakes. Unfortunately, you cannot photograph the sketch during the consultation unless the initial payment has already been made.
1.7. Please advise me of any allergies or specific dietary requirements when booking your consultation.
2. Payment schedule and pricing changes
2.1. All wedding cake orders require a non-refundable initial payment of £50 and the balance payment due date will be advised at time of booking.
2.2. For cake orders with fewer than four weeks’ notice the full cost of the cake must be paid promptly against invoice at time of booking.
2.3. You will be sent an invoice for the amount due at time of booking, and any further payments due will be invoiced no later than six weeks before the event date.
2.4. All initial payments must be paid by the end of the due date indicated on the invoice. After this time, if no payment has been received then the event date will be released.
2.5. All orders are only confirmed when the initial payment has been received. Please note that all initial payments are non-refundable and are only transferrable in certain circumstances. See sections 15, 16 and 18 below.
2.6. Once the cake design has been finalised the price can be agreed. You will then be sent an invoice for the balance payment approximately six weeks before your event, with the payment due no later than 28 days before your event. The due date will be clearly stated on the bottom of the booking form and on the invoice. This final payment is then non-refundable once received, except where Louise Cannon Cakes is unable to fulfil your order (see section 15.7 below).
2.7. If the final payment is not received by the end of the date indicated on your invoice, then I have the right to cancel your booking. The initial payment made to secure your date is then non-refundable to cover administration work already carried out.
2.8. All payments are to be made by BACS transfer, cash or cheque. Bookings with payments made by cheque are only confirmed once the money has cleared, and balance payment cheques must clear no later than 28 days before the wedding date.
2.9. Due to potential for changes in ingredient and other costs, for orders due for fulfilment over 12 months from the order date the price given at time of booking is an estimate only. The final price will be agreed with you before the final payment is due. If you do not accept the revised price you will be eligible for a refund of monies paid minus costs incurred, and any custom items such as toppers already purchased which cannot be used for other orders will be handed over to you.
3. Cake details
3.1. Once the booking form has been sent, please review all the details carefully especially: cake tier sizes, flavour choices, spellings of names, allergen information, delivery time and contact numbers – please advise me of any changes as soon as possible.
3.2. The cake will be made according to the booking form and therefore it is imperative that you check all details carefully. Any errors not picked up on the booking form before the cake is made will not be considered to be my error.
4. Decorative items supplied by third parties
4.1. I cannot be held responsible for delays on items being supplied from other companies e.g. cake toppers, special order cake stands etc.
4.2. If a bespoke cake topper or stand is required, please give me at least one month’s notice to order it but ideally longer.
4.3. If you are ordering a topper or cake stand yourself, please carefully check the size with me to make sure it is suitable for your cake, advise the weight of the item, and ensure the lead time is in line with your event. I would always advise ordering as soon as possible.
4.4. I cannot be held responsible for any errors in size, shape or design for items supplied by you, or where the details were incorrect on the booking form.
4.5. I reserve the right not to use anything supplied by you or a third party if I consider it to be unsuitable or not food-safe.
4.6. If anyone other than me adds toppers or other decoration to your cake this invalidates my liability insurance and I cannot be held responsible for the design change, or any adverse reactions resulting from items being added to the cake in a way that is not food-safe.
5. Fresh flowers/foliage supplied by florists
5.1. When fresh flowers/foliage are being supplied by your florist for addition to a cake, I will liaise with your florist about my requirements, but I would always advise you discuss this with them too.
5.2. The cost of any fresh flowers will be added to your florist’s bill and I would always advise ordering a few extra flowers so I have a good selection to work with.
5.3. Unless otherwise agreed, I will collect the flowers from your florist the day before your event to allow time for me to prepare them for use on your cake.
5.4. I can only work with what your florist provides for me. Please ensure they order flowers and foliage especially for the cake so that they are of the same high standard as the rest of the florals. Any unsuitable or toxic flowers or foliage supplied will not be used on your cake.
5.5. If anyone other than me adds flowers or foliage to your cake this invalidates my liability insurance and I cannot be held responsible for any adverse reactions resulting from the use of toxic items, or where food-safe items have been added to the cake in a way that is not food-safe e.g. inserted directly into the cake.
6. Fresh flowers/foliage supplied by me
6.1. When fresh flowers are being sourced by me for addition to a cake we will agree the selection and colours during your consultation.
6.2. If anyone other than me adds flowers or foliage to your cake this invalidates my liability insurance and I cannot be held responsible for any adverse reactions resulting from the use of toxic items, or where food-safe items have been added to the cake in a way that is not food-safe e.g. inserted directly into the cake.
7. Alterations to orders
7.1. I am happy to make alterations to your cake design and order up to four weeks prior to your event date. Whilst every effort will be made to accommodate changes to the design, please note that changes within four weeks of the event cannot always be guaranteed.
7.2. Changes to cake designs may be subject to an additional cost. This will be discussed with you when making the changes. I reserve the right to increase a quoted price in the event you request a variation to the work agreed.
7.3. Please take the time to check the new copy of the order form with the amendments carefully and let me know by return if any changes are needed. See section 4 above.
8. Collection of cakes
8.1. I prefer to deliver all my cake orders personally, however if this is not possible, your order may be collected at a pre-arranged time. However, not all cakes are suitable for collection, it depends on the design and size of the cake. Cakes over two tiers tall or with intricate decoration or sugar flowers are not suitable for customer collection.
8.2. Cakes that are collected by the customer are always boxed for transportation. I will provide full instructions on the care and handling of your cake. A signature is required upon collection confirming that you have received your order in perfect condition and as specified. I do not take any responsibility for any damage that may occur to the cake once it has left me.
8.3. I advise cakes to be placed on a level, steady surface for transport e.g. in the boot of your car. I do not recommend that cakes are transported in a foot well, on a seat, or held by as passenger and cannot be held responsible for any damage occurring as a result. I am happy to place the cake safely in the car for you if required.
8.4. The cake should be stored in the box at room temperature and out of direct sunlight until displayed. It should then be displayed on a sturdy, level table away from direct sunlight and other heat sources. The cake should not be placed in a fridge at any point unless advised on your collection sheet.
9. Delivery and set-up of wedding cakes
9.1. I will deliver your cake to your venue at a pre-arranged time. I will contact the venue in advance to confirm my arrival time. It is your responsibility to ensure you have given me the correct delivery address and delivery time. This will be on your cake booking form so please check it carefully.
9.2. If the delivery time needs to be changed please advise this as soon as possible but at least 14 days in advance of your event. Depending on other orders on the day of delivery, I cannot always guarantee a change of delivery time will be possible.
9.3. Delivery and set-up charges will be advised during your consultation and are in addition to the cost of your cake. The charge includes stacking and setting up your cake at the venue.
9.4. In the event that the cake table is not ready upon my arrival and this cannot be rectified within 15 minutes after the agreed arrival time I reserve the right to charge you for waiting time at £30 for up to the first hour after the agreed arrival time plus a further £7.50 per 15 minutes thereafter. This will be invoiced to you for payment within seven days of your event date.
9.5. It would be very rare, but on the event day we may be faced with a ‘force majeure’ e.g. severe weather conditions, public unrest, or other unexpected events that may make delivery to your venue impossible. If delivery cannot be made due to force majeure, liability will be limited to a refund by Louise Cannon Cakes of monies received in relation to your order unless you are able to claim under your own wedding insurance policy.
9.6. It is your responsibility to ensure you have provided me with the set-up details and location of the cake at the venue. I cannot be held responsible for the location of the cake at the venue. Please ensure that the display location is level, stable and strong enough to hold the cake. It would be advisable that it is not directly in front of a heat source, in a sunny window/conservatory, or in a location where it could be knocked easily by passing guests.
9.7. I reserve the right to change the location of the cake at the venue if I consider it to be unsuitable and may cause damage to the cake e.g. the cake table is in front of a large glass window, and it is an extremely hot day
9.8. I also reserve the right not to use a cake stand provided by the venue or you if it is unstable, not level, or if I think it will not safely hold the weight of the cake. I have a wide selection of suitable cake stands available to hire if you so wish. This will be discussed at your consultation.
9.9. I will photograph the cake at the venue as proof that it has been delivered, set-up and left in perfect condition. A representative from the venue will be asked to sign a delivery note to confirm this.
9.10. I will not be held responsible for damage caused if the assembled cake is moved after it has been set-up and the delivery note signed.
10. Non-edible elements
10.1. Your cake may contain non-edible elements such as plastic or wooden dowels, plastic flower pics, ribbons or cake toppers. I will advise you of any non-edible elements that need to be removed during cutting and provide written information about this to the venue.
10.2. As I will not personally be cutting the cake, I cannot accept any responsibility for any non-edible elements not removed prior to serving. I will give the venue written information concerning any non-edible elements they need to remove.
11. Shelf life
11.1. I recommend your cake should be eaten within three days of the event to be enjoyed at its best.
11.2. Left over cake can be frozen if you would like to, we can discuss this at your consultation.
12. Allergens and special dietary requirements
12.1. All allergy and special dietary requirements should be conveyed to Louise Cannon Cakes during the booking process, or at the latest during the consultation. It is the customer’s responsibility to make me aware of any special dietary requirements that need to be accommodated in the making of the cake.
12.2. Unless otherwise stated, all cakes contain: wheat flour (gluten), milk and eggs, and are made in an environment that handles nuts, soya, and alcohol. Cakes can sometimes be made on request using gluten-free, nut-free or dairy-free ingredients. However, I cannot guarantee that these cakes will not contain trace amounts of these ingredients due to the nature of the product and production processes.
12.3. I would recommend anyone with a severe nut, dairy or gluten intolerance does not eat your cake.
12.4. I will provide full allergen information with the cake upon delivery to the venue.
12.5. Whilst every effort is made to ensure allergen information is accurate and provided to you, Louise Cannon Cakes cannot guarantee the absence of trace allergens. I therefore cannot accept liability for allergic reactions where full information has been provided and acknowledged.
13. Publication and promotional rights
13.1. The company, Louise Cannon Cakes is the sole designer and owner of the final cake design. All rights in any original designs created and designed by the company shall remain the exclusive property of the company.
13.2. I will photograph your cake and will own the copyright on those photographs. I reserve the right to use any photographs for display or promotional purposes but will not share images publicly until after the event date.
13.3. From time to time my designs are published in the media e.g. wedding magazines, websites, and blogs. I reserve the right to use any image of a customer’s cake made by the company for publication after the event date unless previously agreed in writing between the customer and the company.
13.4. The customer has no ownership rights over any cake design. Exclusivity of cake designs between customers is not guaranteed unless the customer commissions an exclusive design.
14. Commissioning a cake that is similar to another design
14.1. If you wish to have me recreate someone else’s design, I would prefer not to directly copy it, but to use it as a basis to design your cake around so that it is unique to you. This can be discussed at your consultation.
14.2. If you request an exact copy of a cake that is not my original design, I will seek the permission of the original designer to recreate it. This cannot be guaranteed.
15. Cancellations and refunds
15.1. The initial payment is non-refundable in the event of you cancelling your order.
15.2. If your event date changes the payment can be transferred to your order for the new date if I have availability, but your booking will then be subject to the terms and conditions valid at the time of the change.
15.3. Cancellations from the date of booking until 28 days before the wedding will forfeit the initial payment as a cancellation fee (see 15.6 below). You will also be invoiced for any items purchased for your cake which cannot be used on other orders including but not limited to custom toppers or colour-matched decorations.
15.4. Cancellations with between 8 to 28 days notice before the wedding are subject to a cancellation fee of 50% of the order value (see 15.6 below) plus the cost of any items purchased for your cake which cannot be used on other orders including but not limited to custom toppers or colour-matched decorations.. If you have already paid in full you will be issued a refund minus the 50% cancellation fee and cost of any special items purchased. If you have not yet paid in full you will be invoiced for the amount now due.
15.5. Cancellations within 7 days of the wedding are subject to a 100% cancellation fee (see 15.6 below). If this has not already been paid then the final balance will be invoiced as immediately payable upon cancellation.
15.6. Any cancellation fees are calculated to cover work already undertaken in the run up to your wedding which may include but is not limited to: phone calls, emails, completing and sending forms, holding consultations, providing taster boxes, ingredients and stock purchase and the sourcing of any decorations specific to your order, costs incurred, and business lost from declining other bookings.
15.7. There may be a rare occasion when Louise Cannon Cakes needs to cancel an order due to exceptional circumstances beyond my control (excluding forces majeure – see section 9.5 above). In this case, as much notice as possible of the cancellation will be given and any monies paid, including initial payments and equipment hire deposits will be refunded. If required, I will also assist in finding a replacement baker of the same high standard to make your cake for you.
15.8. Cancellations and refund requests can only be discussed with the person who booked the cake originally.
16. Change of wedding date
16.1. If you need to change your wedding date, please let me know as soon as possible. Any changes are subject to availability and are not guaranteed. Please liaise with me to check availability before moving your wedding date. I always advise getting more than one new date option from your venue for a move of date to give me the best chance of being able to change the date.
16.2. If I can change your wedding date, and your original date is over six months from the day you request the change, the initial payment and any other money paid will be transferred to the new date.
16.3. If I can change your wedding date, and your original date is within six months from the day you request the change, the original booking will be classed as a cancellation and the initial payment will be forfeit as a cancellation fee as it is highly likely that I will have turned down other orders for your first date. Your new date will be subject to a new booking fee of £50 which will be added to your final balance unless I am able to fill the original date.
16.4. If you are moving your wedding to a date I for which am unavailable the date change will be classed as a cancellation and cancellation fees will apply – see section 15 above.
16.5. Date changes may be subject to revised pricing depending upon factors including but not limited to inflation, the retail price index, and changes in other business costs from the originally booked date. This will be discussed when you request the date change.
16.6. I would strongly advise that you take out wedding insurance that covers you in the event of a cancellation/change of wedding date that is out of your control.
16.7. Change of date requests can only be accepted from the person who booked the cake originally.
17. Complaints
17.1. In the unlikely event there is an issue with your cake, it must be brought to my attention within 48 hours of the cake being delivered so I can be given the opportunity to assess the nature of the problem. I would take any complaints very seriously.
17.2. If the compliant is regarding the quality of the cake, I may ask for the cake or the remainder of the cake to be returned to me within 48 hours of delivery for inspection.
17.3. If the complaint is regarding the design of the cake, but the cake was made according to the booking form and sketch which has been checked and approved, I cannot be held responsible for any errors not picked up by the customer.
17.4. For any complaints I can only deal with the person who booked the cake originally.
17.5. I kindly request that you give me an opportunity to resolve any issues before posting publicly.
18. COVID 19 or other public health restrictions
18.1. If your wedding cake booking has to be amended due to COVID 19 or other public health restrictions, I will try my best to be accommodating and flexible.
18.2. If you need to postpone your booking because your wedding date falls under a period of Government restrictions, e.g. a national lockdown or Tier 3 / Tier 4 restrictions where weddings are limited to 15 people or fewer, or if they are not allowed all together, then as long as I am free on your new date, I will move the deposit paid across to the new date for you subject to the conditions below.
18.3. If I can change your wedding date, the initial payment and any further payments received will be transferred to the new date.
18.4. If I am not able to accommodate your date change request, the initial payment and the cost of any special items purchased for your cake will be retained to cover work already completed in the run up to your wedding which may include but is not limited to: phone calls, emails, completing and sending forms, holding consultations, providing taster boxes, ingredients and stock purchase and the sourcing of any decorations specific to your order. The balance will be refunded to you and you will be welcome to collect the custom items from me.
18.5. If you decide to postpone your wedding as you are worried about future COVID 19 or other public health restrictions, but restrictions are not currently in place for your wedding date, it will be treated as a standard change of wedding date or a cancellation. See sections 15 and 16 above.
18.6. Any date changes to future years or from off peak to peak days/months, may be subject to price increases in line with section 16.5 above.
18.7. Any subsequent voluntary cancellation will be subject to the terms outlined in section 15 above.

2.2 I reserve the right to change the design at any point if the circumstances are beyond my control or may compromise the quality of the cake. I will consult with you on any significant changes.
3. Price changes
3.1 Due to potential for changes in ingredient and other costs, for orders due for fulfilment over 12 months from the order date the price quoted at time of booking is an estimate only. The final price will be agreed with you before the final payment is due. If you do not accept the revised price you will be eligible for a refund of monies paid minus costs incurred, and any custom items such as toppers already purchased which cannot be used for other orders will be handed over to you.

5. Delivery and set-up
5.1 If I deliver the cake to a venue, photographs will be taken and you or a contact at the venue will be required to sign a delivery note to confirm that the cake was left in good condition. I am not responsible for damage to the cake once it has been handed over to the venue.
6. Display

7. Allergens and special dietary requirements
7.1. All allergy and special dietary requirements should be conveyed to Louise Cannon Cakes during the booking process, or at the latest during the consultation. 8. Equipment hire
8.1 If your order includes hire of equipment such as cake plates, separators or stands this will be subject to specific terms and conditions which will be supplied separately.
9. Cancellation by me
9.1 If I need to cancel your order for any reason other than non-payment of final balance I will try to offer an alternative solution.
9.2 If an alternative is not acceptable or possible I will make a full refund of any payment received including the initial payment.
10. Cancellation by you
10.1 If you cancel your order up to one month before the agreed delivery date, the initial payment will be retained to cover work already undertaken, costs incurred, and business lost from declining other bookings. Any other outstanding balance will be cancelled or payments refunded.
10.2 If you cancel your order within one month before the delivery date the full cost of the order minus any equipment hire security deposits paid will be retained as a cancellation fee to cover work already undertaken, costs incurred, and business lost from declining other bookings.
10.3 The exception: If your event is cancelled or moved due to pandemic-related restrictions I will either transfer your order to a new date or refund all money paid minus any costs already incurred.
11. Complaints procedure
11.1 Complaints must be submitted to me with photographic evidence within 48 hours of delivery/collection.
11.2 Where damage is deemed by me to be as a result of incorrect handling, storage or transportation, or other factors beyond my control no refund or replacement will be given.
11.3 For complaints related to quality, it is your responsibility to return the cake to me within seven days of delivery/collection for investigation.
11.4 If the cake is not returned within seven days then no refund or replacement will be made.
11.5 No goods can be returned unless agreed by me in writing.
11.6 I kindly request that you give me an opportunity to resolve any issues before posting publicly.
12. Publication and promotional rights
12.1. The company, Louise Cannon Cakes is the sole designer and owner of the final cake design. All rights in any original designs created and designed by the company shall remain the exclusive property of the company.

12.3. From time to time my designs are published in the media e.g. magazines, websites, and blogs. I reserve the right to use any image of a customer’s cake made by the company for publication after the event date unless previously agreed in writing between the customer and the company.
12.4. The customer has no ownership rights over any cake design. Exclusivity of cake designs between customers is not guaranteed unless the customer commissions an exclusive design.
13. Commissioning a cake that is similar to another design
13.1. If you wish to have me recreate someone else’s design, I would prefer not to directly copy it, but to use it as a basis to design your cake around so that it is unique to you. This can be discussed before you confirm your order.
13.2. If you request an exact copy of a cake that is not my original design, I will seek the permission of the original designer to recreate it. This cannot be guaranteed.
Display item hire T&Cs

Nothing contained within these terms and conditions affects your statutory rights as a consumer. If there is anything you don’t understand please feel free to contact me.
I reserve the right to revise and amend these terms and conditions. However, you will only be subject to the terms and conditions in force at the time you place your order with me. If you change your event date for any reason, you will be sent the most up to date terms and conditions with your new booking form and these will supersede any previously sent to you.
By paying your hire charge, security deposit, and where applicable the collection (VIP hire) fee, you are agreeing to the terms and conditions supplied so please read them carefully.
1. Display Item Hire
1.1. I have a range of cake stands available to hire for your event. The cost of this (hire charge) is £30.00 per stand hired. If more than one stand is required the hire charge is multiplied by the number of stands hired.
1.2. All stand hire is subject to a refundable security deposit of £100 per stand. If more than one stand is required the hire charge is multiplied by the number of stands hired.
1.3. All hire charges, collection fees and security deposits are payable in advance before the event by the date detailed on your booking form.
1.4. The Hire Period is defined as the time from cake delivery until the stand has been returned by you (Basic hire package) or collected by me (VIP hire package).
1.5. Basic hire package
1.5.1. Hired items must be returned to me within seven days of the event date unless previously agreed. If items are not returned within seven days or by the agreed return date then a late return fee of £5 per day per item will be charged and will be deducted from the security deposit.
1.5.2. If items are not returned within 14 days of the event or agreed return date, then the entire security deposit will be forfeited.
1.5.3. If a late return has been previously agreed in writing then no late fee will be charged on the condition that the items are returned by the new specified date.
1.6. VIP hire package
1.6.1. A collection fee of £30.00 is added to the booking to cover collection costs.
1.6.2. It is your responsibility to ensure that each stand is handed to the venue for safe storage in any provided packaging until I can collect.
1.6.4. I will liaise with the venue before and on the day to ensure storage instructions are clear and to agree the collection date.
1.6.3. If the hired items are not available for collection as agreed the security deposit will be forfeited.
2. Damage to hired items
2.1. All hired items will be photographed by me at the start of the hire period and these photographs will be shared with you as a record of condition.
2.2. All hired items will be assessed on collection or return and compared with the pre-hire photographs.
2.3. If items are considered by me to have been damaged during the hire period then I will discuss this with you some or all of the security deposit may be forfeited to cover cost of repair or replacement:
2.3.1 If the item can be repaired e.g. by obtaining a new part or by expert restoration then only the cost of repair plus an admin fee of £10 will be charged and any balance refunded promptly.
2.3.2. If the item is lost or damaged beyond repair the cost of its replacement will be deducted from the security deposit and any balance refunded promptly.
3. Cancellation
3.1. In the event that your stand hire is cancelled by you more than 28 days before the event date the hire charge and security deposit will be returned.
3.2. In the event that your stand hire is cancelled by you fewer than 28 days before the wedding the hire charge will be forfeit as a cancellation fee to cover loss of income because the stand was not available for other customers to hire. The security deposit will be refunded in full.
3.3. In the event that I have to cancel your equipment hire I will do my best to secure and alternative stand if required. The hire charge and security deposit you have paid to me will be used to hire the alternative equipment. Where the security deposit is higher than the amount you have already paid I will pay the difference and invoice this to you so that responsibility for the equipment’s safe return is fully with you.
